This Privacy Policy describes how Fast Power Sports ("Fast Power Sports", "we", "us", or "our"), a United States-registered watercraft manufacturer based in Anthem, Arizona, collects, uses, discloses, and protects personal information when you visit this website, request a quote, place a merchandise order, or otherwise interact with us online.

This policy applies to visitors and customers located in the United States. It is intended to meet the requirements of applicable US federal privacy law and the comprehensive state privacy laws listed in Section 11, including the state-specific rights described in Section 12.

2. Specific pieces of personal information we collect

Depending on how you interact with the site, we collect the following specific pieces of personal information:

• Identity and contact details — your full name, email address, phone number, and shipping and billing address, as entered on quote, contact, or order forms.
• Inquiry content — the model you ask about (GP1R or F16), your build preferences, and the free-text messages you send us.
• Order details — the merchandise items, sizes, and quantities you order, delivery status, and return or exchange requests.
• Payment references — confirmation that a payment succeeded and the transaction reference from our payment processor. Full card numbers are handled by the processor and never stored by us.
• Device and usage data — IP address, browser type and version, device type, pages viewed, links clicked, referring URLs, and approximate location derived from your IP address.
• Communications — records of emails or messages between you and the team, including privacy-rights requests.
• We do not knowingly collect sensitive personal information through this website — no government identifiers, precise geolocation, health data, account passwords, or biometric data.

3. How we use your information

• To respond to quote requests and build inquiries for GP1R, F16, and related watercraft.
• To process, fulfill, and ship merchandise orders, and to provide order support and handle returns.
• To operate, maintain, and secure the website, including fraud prevention and debugging.
• To communicate with you about your inquiry or order, and — where permitted — about products, events, and race program news you may opt into.
• To comply with legal obligations, enforce our terms, and protect our rights, property, and safety and that of our customers.

4. Cookies and tracking technologies

We use cookies and similar technologies required for the site to function (for example, keeping your shopping cart) and may use analytics tools to understand how the site is used.

You can set your browser to refuse cookies or alert you when cookies are being set; some site features may not function without them.

Where required by state law, we treat a recognized Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information and of targeted advertising for that browser or device.

5. How we share information

We do not sell your personal information for money, and we do not share your personal information for cross-context behavioral advertising as those terms are defined under state privacy laws.

• Service providers: shipping carriers, payment processors, website hosting, and email service providers that process information on our behalf under contract and only for the services they provide to us.
• Legal and safety: when required by law, regulation, legal process, or to protect the rights, property, or safety of Fast Power Sports, our customers, or others.
• Business transfers: in connection with a merger, acquisition, or sale of assets, subject to the protections of this policy.

6. Data retention

We keep personal information only as long as needed for the purposes described in this policy — including fulfilling orders, maintaining business and tax records, resolving disputes, and meeting legal obligations — after which it is deleted or de-identified.

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information we hold, including encrypted connections (HTTPS) and limiting access to personal information to those who need it.

No method of transmission or storage is completely secure; if we learn of a breach affecting your personal information, we will notify you and the authorities as required by applicable state breach-notification law.

8. Children's privacy

This website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in accordance with the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided us personal information, contact us and we will delete it.

9. Do Not Track and Global Privacy Control

Some browsers transmit "Do Not Track" signals; because there is no common industry standard, our site does not respond to browser Do Not Track signals.

We do honor the Global Privacy Control (GPC) signal where required, as described in Section 4.

10. Third-party links

This site links to third-party websites, including social media platforms, video platforms, and industry supplier sites. We are not responsible for their privacy practices; their own policies apply when you visit them.

11. State privacy laws covered

Depending on where you live, you may have specific rights under your state's comprehensive consumer privacy law. As of this policy's date, states with enacted comprehensive laws include: California (CCPA, as amended by the CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Florida (FDBR), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), Iowa (ICDPA), Delaware (DPDPA), Nebraska (NBDPA), New Hampshire (NHDPA), New Jersey (NJDPA), Tennessee (TIPA), Minnesota (MCDPA), Maryland (MODPA), Indiana (INCDPA), Kentucky (KCDPA), and Rhode Island (RIDTPPA) — all in effect — plus Oklahoma (effective January 1, 2027), Louisiana (effective January 1, 2027), Alabama (effective May 1, 2027), and Vermont (effective January 1, 2028), along with any similar laws enacted after this policy is updated.

The rights below summarize what these laws generally provide. Where your state's law differs, the more protective right applies.

12. Privacy rights in every US state

You do not need to live in a state with a comprehensive privacy law to have control over your information. As a matter of policy, Fast Power Sports extends the core rights described in Section 14 — access, correction, deletion, and portability — to every visitor and customer in all 50 US states and the District of Columbia.

Because we do not sell personal information or share it for targeted advertising, the opt-out rights described in Section 14 currently have nothing to attach to in any state; if that ever changes, this policy will be updated and the required opt-out links provided before any such activity begins.

Residents of states with enacted comprehensive laws may also have additional statutory rights (such as appeal rights and authorized-agent requests); those apply as provided by your state's law.

13. Your state privacy rights

• Right to know / access: request confirmation of whether we process your personal information and a copy of it, including the specific pieces listed in Section 2.
• Right to correct: request that we correct inaccurate personal information.
• Right to delete: request deletion of personal information we hold about you, subject to legal exceptions (for example, completing a transaction or keeping records the law requires).
• Right to data portability: receive a copy of your personal information in a portable, readily usable format.
• Right to opt out: opt out of (a) the sale of personal information, (b) the sharing of personal information for cross-context behavioral / targeted advertising, and (c) profiling in furtherance of decisions producing legal or similarly significant effects. As stated in Section 5, we do not sell or share personal information in these ways, so there is currently nothing to opt out of; if that changes, this policy and a "Do Not Sell or Share My Personal Information" link will be provided before any such activity begins.
• Right to non-discrimination: we will not deny goods or services, charge different prices, or provide a different level of quality because you exercised any privacy right.
• Right to appeal: if we decline to act on a request, you may appeal by replying to our decision; we will respond within the time your state's law requires and explain how to contact your state attorney general if you remain unsatisfied.

14. California-specific disclosures

Categories of personal information collected (Cal. Civ. Code §1798.100 et seq.): identifiers (name, email, phone, address, IP address); commercial information (purchase and inquiry history); internet or other electronic network activity (pages viewed, device data); and customer records as defined by California law. We do not collect biometric, precise geolocation, or other sensitive categories through this site.

California residents may request, up to twice in a 12-month period, the specific pieces and categories of personal information we have collected, the categories of sources, the business purposes, and the categories of third parties with whom it is shared.

Shine the Light (Cal. Civ. Code §1798.83): we do not disclose personal information to third parties for their own direct marketing purposes.

Authorized agents: California residents may use an authorized agent to submit a request; we may require the agent to provide proof of written permission and may ask you to verify your identity directly.

15. How to exercise your rights

Submit a request through the contact options on our Contact page, stating your state of residence and the right you wish to exercise.

We will verify your identity before acting — typically by confirming details we already hold, such as the email address used on an order. We will respond within 45 days where your state's law sets that deadline, with one permitted extension where allowed.

If you have an account-related or order-related question rather than a privacy request, the same contact route works.

16. Changes to this policy

We may update this Privacy Policy from time to time. The revised version will be posted on this page with an updated effective date, and material changes will be highlighted where the law requires.
